The JFBA’s Policy on the Protection of Personal Information


The Japan Federation of Bar Associations (the “JFBA”) holds and uses personal or other related information (which refers to: (a) personal information, (b) information related to personal information, (c) pseudonymized personal information, and (d) anonymized personal information; the terms hereinafter appearing are to be interpreted as used in the Act on the Protection of Personal Information (Act No. 57 of 2003, the “Act”) unless otherwise defined herein) of many individuals in the course of its activities in order to carry out its mission of protecting fundamental human rights and achieving social justice. The JFBA considers protecting such information as a serious responsibility, and establishes this policy as follows in order to gain public trust and make efforts to protect such information.


In compliance with applicable laws and regulations, and the JFBA’s rules, the JFBA will ensure that the following articles are informed and implemented by the JFBA’s executives, Secretary General, Deputy Secretary Generals, other employees and attorney officers, as well as its regular members, special members, foreign special members, joint corporation members and quasi-members, who are entrusted by the JFBA with the task of handling personal or other related information held by the JFBA, and properly handle such information.

Article 1 Proper Acquisition, Use, Provision and Entrustment of Personal Information


  1. 1. Except in cases in which any of the exceptions set forth in the Act applies, the JFBA will properly acquire necessary personal information while explicitly specifying the purpose of use, inform or disclose the purpose of use, and properly use such information within the scope of the purpose of use.


  1. 2. Personal data held by the JFBA will not be provided or disclosed to a third party, except in the following cases.
  1. (a) Cases in which the prior consent of the identifiable person has been obtained for such provision or disclosure.
  1. (b) Cases in which such provision or disclosure is done according to laws and regulations.
  1. (c) Cases in which there is a need to protect the life, wellbeing, or property of an individual, and it is difficult to obtain the consent of the identifiable person.
  1. (d) Cases in which there is a special need to improve public wellbeing or promote healthy child development, and it is difficult to obtain the consent of the identifiable person.
  1. (e) Cases in which there is a need to cooperate with a national government organ, local government or person entrusted thereby with performing the functions prescribed by laws and regulations, and obtaining the consent of the identifiable person is likely to interfere with the performance of those functions.
  1. (f) Cases in which the JFBA is considered to be an academic research institution or the equivalent, and the provision of personal data for the purpose of publication of academic results or teaching is unavoidable (excluding cases in which there is a risk of unjustly infringing on individual rights and interests)
  1. (g) Cases in which the JFBA is considered to be an academic research institution or the equivalent, and needs to provide personal data for the purpose of academic studies (including cases in which a part of the purpose of providing the personal data is for academic research purposes, and excluding cases in which there is a risk of unjustly infringing on individual rights and interests)(limited to cases in which the JFBA and the third party jointly conduct academic research)
  1. (h) Cases in which the third party is an academic research institution or the equivalent, and the third party needs to handle the personal data for academic research purposes (including cases in which a part of the purpose of providing the personal data is for academic research purposes, and excluding cases in which there is a risk of unjustly infringing on individual rights and interests)


  1. 3. In cases in which the JFBA uses personal data by entrusting it to a third party, it will take necessary measures including having the third party sign a non-disclosure agreement before the provision of such data and exercise appropriate supervision over the entrusted party.


  1. 4. With respect to matters not mentioned above, the JFBA will handle personal information in compliance with the Act, its subordinate legislations, and related guidelines.

Article 2 Provision of Information Related to Personal Information


  1. With respect to the provision of information related to personal information to a third party, where such information is expected to be obtained as personal data by the third party, the JFBA will confirm the matters required in accordance with the provisions set forth in the Act.

Article 3 Appropriate Preparation, Use and Provision of Pseudonymized Personal Information


  1. 1. The JFBA will prepare pseudonymized personal information in compliance with the Enforcement Rules for the Act on the Protection of Personal Information (Rules of the Personal Information Protection Commission No. 3 of 2016; the “Enforcement Rules”).


  1. 2. The JFBA will not provide pseudonymized personal information to a third party, unless permitted by laws and regulations.


  1. 3. With respect to matters not mentioned above, the JFBA will handle pseudonymized personal information in compliance with the Act, its subordinate legislations, and related guidelines.

Article 4 Appropriate Preparation, Use and Provision of Anonymized Personal Information


  1. 1. The JFBA will prepare anonymized personal information in compliance with the Enforcement Rules and disclose the categories of information on an individual that is contained in the anonymized personal information after preparing it.


  1. 2. With respect to the provision of anonymized personal information to a third party, the JFBA will disclose the categories of information on an individual that is contained in the anonymized personal information to be provided to the third party, and the means of providing this information before providing it to the third party, in accordance with the provisions set forth in the Enforcement Rules.


  1. 3. With respect to matters not mentioned above, the JFBA will handle anonymized personal information in compliance with the Act, its subordinate legislations, and related guidelines.

Article 5 Measures for Managing the Security of Personal or Other Related Information


  1. The JFBA will take security measures to prevent or rectify unauthorized computer access and the leaking, loss or damage of the personal or other related information.


  1. Where an incident concerning the security of such information occurs, the JFBA will act in compliance with the Act, its subordinate legislations, and related guidelines.

Article 6 Improvement Measures


  1. The JFBA will make efforts to appropriately adapt to changes in the social environment regarding the handling of personal or other related information.


  1. The JFBA will improve its measures as necessary by making changes, amendments, or additions to this policy and the JFBA’s other rules.

Article 7 Responding to Requests for Disclosure, Correction, etc.


  1. A person who (a) believes that the JFBA is failing to comply with this policy; (b) wishes to make a request for disclosure, correction or suspension of use of their personal information stored in databases used by the JFBA; or (c) wishes to make a request for disclosure of records on provisions of their personal information to third parties must submit an inquiry to our contact point a web link to which can be found at the bottom of this page. The JFBA will respond to such inquires swiftly, but within a reasonable scope.

Article 8 Processing of Complaints


  1. The JFBA will properly respond to complaints on its handling of personal or other related information.


  1. This policy came into effect as of April 1, 2005, and has been amended on October 5, 2015, May 30, 2017, and April 1 and November 1, 2022.




The scope of application of this policy is limited to within the JFBA and its website. The JFBA takes no responsibility for the protection of personal or other related information on other websites linked from the JFBA’s website.
